Selling a note in Illinois: what’s different here

  • Mortgages are foreclosed in court. Illinois mortgages are foreclosed through a court case under the Illinois Mortgage Foreclosure Law. For a home, the owner’s redemption period generally ends at the later of seven months after being served or three months after the judgment (735 ILCS 5/15-1603).
  • Borrowers can reinstate once in five years. Within 90 days after being served, the borrower can cure the defaults and pay the costs without paying the full accelerated balance. Once a court finds this right was used, it isn’t available again under the same mortgage for five years (735 ILCS 5/15-1602).
  • Installment contracts must be recorded. A seller using an installment sales contract must record the contract or a memorandum of it with the county within 10 business days (765 ILCS 67/20), and many residential installment contracts must be foreclosed like a mortgage (735 ILCS 5/15-1106). A recorded contract is worth more to a buyer.

Where your Carbondale note is recorded

When you sell a note, the mortgage, deed of trust or contract is assigned to the buyer, and the assignment is recorded with the same county office that recorded the original. Carbondale is in Jackson County, whose county seat is Murphysboro; a small part of the city is in Williamson County.

Jackson County Clerk & Recorder

Recording fees are paid in advance, and a deed needs the property identification number, so have it ready along with your recorded mortgage or installment contract.

How selling your note works

  1. Tell us about the note

Use the quote form or call 618-816-5161. The basics are enough: the balance, the payment, how many payments are left and the property address.

  2. Send the documents

The promissory note, the recorded mortgage, deed of trust or installment contract, the closing statement and the payment history.

  3. Get a written offer

A note specialist reviews the payment history, the property and the payer, then sends you a written offer for all or part of the note.

  4. Close and get paid

Closing runs through a title company or attorney. You receive one lump sum, and your borrower is told where to send future payments.

What it means for you: Carbondale is a college town where most households rent, so many local notes come from landlords and small investors who sold rental homes on terms. In a market this size, a buyer looks most closely at the payment history and the property itself rather than at citywide numbers.

Questions from Carbondale note holders

Do you buy notes around Carbondale?

Yes: in Carbondale, Murphysboro, Carterville, Marion and Herrin, across Jackson, Williamson, Union, Perry and Franklin counties, and anywhere else in Illinois.

My buyer pays me on a installment contract. Can I sell it?

Often, yes. Send us the installment contract and the payment history and we’ll review it. A installment contract that’s properly recorded, with clean payment records, is worth the most.

What happens if my borrower stops paying?

Illinois mortgages are foreclosed through a court case under the Illinois Mortgage Foreclosure Law. For a home, the owner’s redemption period generally ends at the later of seven months after being served or three months after the judgment (735 ILCS 5/15-1603).

Do I have to live in Carbondale to sell my note?

No. The property has to be in or around Carbondale; you can live anywhere. Closings run through a title company or attorney, and documents can be signed with a mobile notary.

What will I get for my Carbondale note?

It depends on the balance, the interest rate, the payment history, the equity in the property and the payer’s credit. A note specialist reviews those and sends you a written offer. The quote is free and there’s no obligation.
